Important Disclosure

Not a Law Firm Disclaimer

This page explains what National Excess Proceeds Exchange is — and what it is not. Please read this disclosure carefully. It contains important information about the nature and limits of NEPEX's services.

NEPEX Is Not a Law Firm

National Excess Proceeds Exchange is an educational organization and referral exchange. We are not a law firm. We do not practice law. We do not provide legal advice. We are not a government agency. Nothing on this website constitutes legal advice, and nothing on this website creates an attorney-client relationship.

1. What National Excess Proceeds Exchange Is

National Excess Proceeds Exchange ("NEPEX") is an educational organization that provides information about excess proceeds, surplus funds, tax sale overages, foreclosure surplus, and related topics. Our mission is to help former property owners, heirs, families, and professionals understand a complex and often confusing area of real estate and property law.

The services NEPEX provides are limited to:

  • Publishing educational articles, guides, checklists, and resources about excess proceeds and related topics
  • Conducting preliminary educational reviews to help individuals understand whether excess proceeds may exist in a given situation
  • Coordinating referrals between consumers and qualified professionals, including attorneys, title professionals, and probate specialists
  • Providing consumer protection information to help individuals identify and avoid predatory practices in the excess proceeds industry

These services are educational and administrative in nature. NEPEX does not perform any services that constitute the practice of law.

2. NEPEX Does Not Practice Law

NEPEX is not authorized or licensed to practice law in any jurisdiction. NEPEX does not employ attorneys in a legal practice capacity, does not hold itself out as qualified to perform legal services, and does not perform any of the following functions:

  • Providing legal advice, opinions, or recommendations to any individual or entity
  • Drafting or filing legal documents, pleadings, motions, or claims with any court, government agency, or other tribunal
  • Representing any individual or entity in court, before a government agency, or in any legal proceeding
  • Negotiating settlements, handling disputes, or otherwise acting as legal counsel
  • Interpreting statutes, regulations, court rules, or case law for the purpose of advising a specific individual about their legal rights or obligations
  • Holding client funds in trust, operating a client trust account, or otherwise handling funds in a fiduciary capacity

If you need any of these services, you must consult a qualified attorney licensed in the relevant jurisdiction. NEPEX cannot and will not act as your attorney.

3. NEPEX Does Not Provide Legal Advice

All content on this website — including articles, guides, checklists, state-specific resources, frequently asked questions, form instructions, and any other materials — is for general informational and educational purposes only. This content does not constitute legal advice.

Legal advice is the application of law to a specific individual's specific circumstances by a qualified professional who is authorized to practice law in the relevant jurisdiction. General educational information about how excess proceeds work, what the claim process typically involves, or what factors may affect recovery is not legal advice, and it should not be relied upon as such.

If you need legal advice — meaning an analysis of how the law applies to your specific situation, in your specific jurisdiction, given your specific facts — you must consult a qualified attorney licensed in that jurisdiction. Do not rely on educational information on this website as a substitute for personalized legal advice.

4. NEPEX Is Not a Government Agency

National Excess Proceeds Exchange is a private entity. It is not a government agency, is not affiliated with any government agency, and does not represent any government entity. Specifically:

  • NEPEX is not the custodian, holder, or administrator of any excess proceeds, surplus funds, or unclaimed property
  • NEPEX cannot disburse, release, authorize, or facilitate the release of any funds held by a government entity
  • NEPEX does not have access to government-held funds and cannot transfer or direct the transfer of such funds to any individual
  • NEPEX does not set, interpret, or enforce government policies, rules, or procedures
  • Communication from NEPEX does not constitute government communication, notice, or instruction

If you are seeking to claim funds held by a government entity, you must follow that entity's procedures. NEPEX can provide educational information about those procedures, but cannot act on your behalf or on behalf of the government entity.

5. No Attorney-Client Relationship

Your use of this website, your submission of information through any form, your participation in any educational review, and any communication with NEPEX — whether by email, phone, text message, or any other means — does not create an attorney-client relationship between you and NEPEX or between you and any entity or individual affiliated with NEPEX.

An attorney-client relationship is a formal legal relationship that arises when a client engages an attorney to provide legal services and the attorney agrees to do so. This relationship is governed by specific ethical rules and carries specific rights and obligations — including the attorney-client privilege, which protects confidential communications between attorney and client. NEPEX is not an attorney, cannot enter into an attorney-client relationship, and cannot provide the protections that flow from such a relationship.

Information you share with NEPEX is not protected by attorney-client privilege or the work product doctrine. If you need a relationship protected by these privileges, you must engage a licensed attorney directly.

6. Referral to Licensed Attorneys

In some cases, after an educational review, NEPEX may coordinate a referral to a licensed attorney, title professional, or other qualified professional who may be able to assist with an excess proceeds claim. This referral is an administrative coordination only. NEPEX does not:

  • Employ, supervise, direct, or control the work of any attorney or law firm
  • Guarantee the quality, competence, or outcome of any attorney's work
  • Make representations about any particular attorney's experience, skill, or suitability for a given matter
  • Set, control, or influence the fees charged by any attorney
  • Participate in or have any responsibility for the attorney-client relationship that may form between a visitor and an attorney

Any attorney-client relationship that forms following a referral is solely between the visitor and the attorney. Visitors are encouraged to independently evaluate any attorney before engaging their services — including verifying the attorney's license status, experience, and professional standing.

7. Recovery of Funds Is Not Guaranteed

NEPEX does not guarantee, promise, or predict that any individual or entity will recover excess proceeds, surplus funds, or any other funds. The existence of possible funds — even funds that appear to be clearly owed to a specific individual — does not mean that the funds can or will be recovered.

Recovery depends on numerous factors, many of which are outside the control of NEPEX or any single professional. These factors include, but are not limited to:

  • Whether statutory deadlines for filing a claim have passed
  • Whether the required documentation can be located, authenticated, and properly submitted
  • Whether competing claims exist from other potential claimants
  • How courts, government agencies, and officials interpret and apply applicable laws and rules
  • Whether the funds have already been disbursed or escheated to the state

Anyone who guarantees, promises, or predicts that excess proceeds will be recovered is making a claim they cannot reliably support. NEPEX does not make such claims, and you should be skeptical of anyone who does.

8. Visitors Should Seek Qualified Legal Counsel

NEPEX strongly encourages every visitor to this website to consult with a qualified attorney licensed in the relevant jurisdiction before taking any action related to an excess proceeds claim. This includes, but is not limited to:

  • Before signing any contract, agreement, retainer, assignment of rights, or fee arrangement with any person or company
  • Before filing any claim, motion, petition, or other legal document with any court or government agency
  • Before making any decision that could affect your legal rights, claims, or interests
  • Before accepting or rejecting any settlement offer
  • Before disclosing personal or financial information to any person or company offering to help recover funds

An attorney can provide personalized advice based on your specific situation, your jurisdiction, and the applicable law. The cost of a consultation with an attorney is often modest compared to the value of the funds at stake — and compared to the cost of making a mistake that could jeopardize a valid claim.

9. Information Is Educational Only

The information on this website is provided solely for educational purposes. While we strive for accuracy, we make no representation or warranty that any information is accurate, complete, current, or applicable to your specific situation or jurisdiction. Laws, regulations, court rules, and county procedures change frequently and vary significantly by jurisdiction.

Educational information about excess proceeds is not a substitute for professional legal, financial, or tax advice. You should not rely on this website's content to make decisions that affect your legal rights or financial interests without first consulting appropriate professionals.
