SMS Terms & Conditions
These SMS Terms and Conditions govern the text messaging program operated by National Excess Proceeds Exchange. By opting in to receive text messages from us, you agree to these terms.
1. Program Overview
The National Excess Proceeds Exchange ("NEPEX," "we," "us," or "our") text messaging program allows us to communicate with individuals who have submitted inquiries, requested educational information, or initiated a preliminary claim review through our website. Messages may include:

- Responses to questions or requests you have submitted

Our text messaging program is not a promotional or marketing campaign. Messages are generally related to specific inquiries or educational reviews that you have initiated.
2. How to Opt In
You opt in to receive text messages from NEPEX by checking the SMS consent checkbox on one of our website forms and submitting that form. The consent checkbox appears near the bottom of each form and reads:
"By checking this box, I agree to receive calls, text messages, and emails from National Excess Proceeds Exchange regarding my inquiry. Message and data rates may apply. Message frequency may vary. Reply STOP to unsubscribe. Reply HELP for help. Consent is not a condition of purchase or service. I have read and agree to the Privacy Policy and Terms & Conditions."
By checking this box and submitting the form, you:
- Expressly authorize NEPEX to send text messages (SMS and MMS) to the phone number you provide
- Confirm that you are the subscriber or authorized user of the phone number provided
- Acknowledge that you may receive texts even if your number is on a do-not-call list, as permitted by applicable law
- Understand that consent is not a condition of using our educational services or receiving a response to your inquiry
We do not pre-check the SMS consent checkbox. The checkbox must be actively checked by you. We maintain records of all SMS opt-in consents, including the date, time, method, and scope of consent provided.
3. Message Frequency
Message frequency varies. The number of text messages you receive depends on the nature of your inquiry and your engagement with our educational process. Typical message patterns include:
- Initial acknowledgment: One message confirming receipt of your form submission or inquiry
- Follow-up messages: A limited number of messages related to your specific educational review, documentation requests, or referral coordination
- Educational messages: Occasional messages providing educational information about excess proceeds, but only when you have consented to receive such information
You are not signing up for a recurring text message subscription or newsletter. You will not receive daily, weekly, or scheduled promotional messages as part of this program.
4. Message and Data Rates
Message and data rates may apply. Standard message and data rates charged by your mobile carrier apply to all text messages sent to and received from NEPEX. You are solely responsible for any charges from your mobile carrier associated with text messaging.
Rates vary by carrier and service plan. Contact your mobile carrier if you have questions about your plan's text messaging rates, data charges, or any limits or restrictions on text messages. NEPEX does not charge any fee for sending or receiving text messages as part of this program. Any charges you incur are from your mobile carrier, not from NEPEX.
5. How to Opt Out — STOP
You may opt out of receiving text messages from NEPEX at any time, for any reason. To opt out, reply with any of the following words to any text message you receive from us:
- STOP
- END
- CANCEL
- UNSUBSCRIBE
- QUIT
Once we receive your opt-out request, we will:
- Send you a single confirmation text acknowledging that you have been unsubscribed
- Cease sending further text messages to your number
- Process your request promptly, generally within a reasonable timeframe
Opting out of text messages does not affect your ability to receive communications through other channels (email, phone) if you have consented to those communications separately. If you have opted out and continue to receive text messages, please contact us immediately.
6. How to Get Help — HELP
For assistance with our text messaging program, you may:
- Reply HELP to any text message you receive from us. You will receive an automated text response with information about our messaging program and contact details for further assistance.

If you are experiencing technical issues with our text messages — such as undelivered messages, formatting problems, or carrier-specific issues — please include your mobile carrier name when you contact us so we can assist more effectively.
7. Supported Carriers
Our text messaging program is available on most major U.S. mobile carriers, including but not limited to: AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket, Metro by T-Mobile, and others. However, delivery of text messages is subject to the terms, conditions, and technical limitations of your mobile carrier.
We are not responsible for delayed or undelivered messages due to:
- Carrier network issues or outages
- Device settings that block or filter text messages
- Your phone number being out of service or transferred to a different carrier
- Your mobile account restrictions or blocks on short code or application-to-person (A2P) messaging
- Your device being powered off or outside a coverage area
If you experience issues receiving messages, please check your device settings and contact your carrier to ensure A2P messaging is not blocked on your account.
8. Privacy and Data Handling
Your phone number, the content of text messages, and related metadata are treated as personal information under our Privacy Policy. We do not sell, share, or disclose your phone number or text message content to third parties for their own marketing purposes.
We may share text message data with service providers who assist us in delivering our messaging services. These providers are contractually obligated to protect your data and use it only for the purposes for which it was disclosed.
We retain text message records in accordance with our data retention practices. You may request access to, correction of, or deletion of your text message data by contacting us, subject to any legal or operational retention requirements.
9. Compliance With Applicable Law
Our text messaging program is designed to comply with applicable laws, regulations, and industry standards, including:

- CTIA Messaging Principles and Best Practices

10. Your Representations

- You are at least 18 years of age
- You understand and agree to these SMS Terms & Conditions
- If your phone number changes, you will notify us promptly
- If you transfer your phone number to another person, you will notify us so we can remove your number from our messaging program
11. Changes to These SMS Terms
We may update these SMS Terms & Conditions from time to time. When we make material changes, we will post the updated terms on this page and update the effective date. If the changes materially affect your rights or the scope of your consent, we may provide additional notice, including by text message where consent for such communications exists.
Your continued receipt of text messages after changes to these SMS Terms are posted constitutes your acknowledgment of the updated terms, provided that the scope of your original consent is not expanded without additional affirmative consent.
